Family Legal Advice Service [FLAS]

If you are eligible for government assistance than you are able to access two FREE sessions with a family lawyer. You can get advice about your options concerning the care of the kids and that lawyer can then help you complete particular forms if you are making a court application, once mediation is completed.

Funding Eligibility

Funding is available for you to help you settle disputes about the kids if you are on a low income. This funding will pay for two sessions with a lawyer. The first session is around your responsibilities and what options there are for you and the second session is designed to help you complete any application or other court form once mediation has been completed.

It will also pay for Family Dispute Resolution (FDR) or mediation.

Eligibility is assessed on the number of people who are financially dependent* on you AND your income over the past 12 months (this is BEFORE tax and any deductions like student loan, kiwi saver etc). If things have recently changed for you, then you can be assessed on the last 3 months. Your income won't include debts, assets or your partner's income

If you have qualified for legal aid in the past year you will also be eligible for funding.

I will assess your funding eligibility as part of the service I provide as The FLAS Specialist Ltd.

*A dependant is a partner who has no income or children who rely on you for financial support, whether or not they are living with you and YES this may include your partner's children if you are regularly making payments for them.

Other Legal Aid and FDR providers

I understand that not all family law practices are able to offer that full range of family law advice - advice that for such a long time included legal aid. The changes that have taken place over recent years has put pay to that.

However, many practitioners take pride in being able to REFER their clients with family disputes to someone who can offer an effective and timely service - the kind of initial family legal advice that they no longer provide.

As The FLAS Specialist Ltd I am able to take such referrals.

I also need to be able to refer clients back to Legal Aid practitioners once section 7A directions have been made. It is therefore important that I establish strong relationships with other regional legal aid providers so that I am able to COMPLETE my service which will include referring clients to fellow legal aid providers once lawyers are permitted to act.

In the case of initial legal advice, I will also make referrals to approved FDR providers (FLAS 1).
